In the case of a Yorkie, “no pets allowed” is overruled.

The appellate court has recently decided that “Charlie can stay” with his owner in the Condominium unit in Middle Village Queens. The house rules clearly stated that ” absolutely no pets were allowed”, however the court decided that the the by-laws of the condominium required that the house rule prohibiting pets was not approved by 80% of the unit owners. Since this house rule was implemented without such approval, they are unable to force the removal of Charlie. Read more
